Third Circuit Bars Natera False Ads, Rejects CareDx Damages Bid

Natera Inc. dodged a $45 million payout but still faces an injunction over false ads touting the superiority of its kidney-transplant tests in a dispute with CareDx Inc., after the Third Circuit affirmed a Delaware judge’s ruling that erased damages but kept liability intact.

“The District Court correctly concluded that there is sufficient evidence for a reasonable juror to find the challenged claims were literally false,” Judge Patty Shwartz wrote in an opinion issued Thursday by the US Court of Appeals for the Third Circuit.
