Thales USA Inc. is unlikely to suffer harm without an order blocking an International Trade Commission action, the Federal Circuit found Wednesday.
The ITC didn’t issue an exclusion order on Thales imports, as the company had feared when it argued the US Court of Appeals for the Federal Circuit needed to bar action by the ITC. Without the commission implementing such an order, Thales couldn’t show the irreparable harm required for the court to stop the ITC, the Federal Circuit ruled in a precedential opinion.
