Makers of an alcoholic beverage called “Y’alls Texas Tea” sued another company for asserting ownership over the trademark “Texas Tea” after allegedly claiming that Texas tea couldn’t be trademarked at all.
In the complaint filed Wednesday in the US District Court for the Western District of Texas, Y’alls Texas Tea makers 1BMF Inc. sought to invalidate the “Texas Tea” trademark held by D.B. Miller Inc. 1BMF said D.B. Miller previously sought to cancel the trademark’s registration when another company brought the application — claiming the name is unavailable for registration because it isn’t distinct.
