Tesla Loses Bid for Tribunal Review of Energy Storage Patent

Tesla Inc. was unable to convince an administrative tribunal to review a patent related to energy storage technology it’s been accused of infringing with its batteries.

Tesla asked the Patent Trial and Appeal Board to review the validity of various claims in Unicorn Energy GmbH’s US Patent No. 10,008,869 after Unicorn brought an infringement suit. Tesla argued the claims it challenged are unpatentable as obvious.

The board said in a Tuesday decision Tesla hadn’t shown a “reasonable likelihood” of establishing the claims are invalid.
