TCL’s Loss in LTE Standard-Essential Patent Case Affirmed

TCL Communication Technology Holdings Ltd. lost its bid to convince the Federal Circuit on Tuesday to toss a jury verdict that it owed nearly $1 million for infringing wireless patents.

In a matter of first impression, the U.S. Court of Appeals for the Federal Circuit said the question of whether a patent is essential to a technological standard can be resolved by a jury, and doesn’t have to be resolved by the court before trial.
