TaylorMade Golf Wants Costco’s Arbitration Bid in Ninth Circuit

Taylor Made Golf Co. told the Federal Circuit its dispute with Costco Wholesale Corp. is better suited in another appellate court because it centers on arbitration rather than patent claims.

A California federal judge’s denial of Costco’s request to push TaylorMade’s patent infringement lawsuit to arbitration wasn’t a final decision, the company wrote in an unopposed motion to transfer filed Wednesday in the US Court of Appeals for the Federal Circuit. TaylorMade said the Federal Circuit has authority over appeals concerning final decisions in patent suits but not orders concerning arbitration.
