Tata Wins Trim of $420 Million Judgment in Trade Secrets Case

Tata Consultancy Services Ltd. convinced the Seventh Circuit Thursday the $280 million in punitive damages it owes electronic health record developer Epic Systems Corp. for stealing trade secrets is “constitutionally excessive.”

The amount, double the compensatory damages award, “exceeds the outermost limit of the due process guarantee in the Constitution,” the U.S. Court of Appeals for the Seventh Circuit said.

But the Seventh Circuit agreed with the trial court that sufficient evidence supports the $140 million compensatory damages award for the benefit Tata received from its unauthorized access of Epic’s software system.
