Tata Consultancy Defeats Whistleblower’s H-1B Visa Fraud Lawsuit

Tata Consultancy Services Ltd. scored dismissal of a whistleblower’s suit alleging that the India-based IT services company fraudulently obtained visas for foreign workers, a Texas federal district court said.

Whistleblower Jack “Jay” Palmer failed to show that Tata violated the False Claims Act because he didn’t sufficiently allege that the company submitted a claim for payment to the government, Judge Amos L. Mazzant III of the US District Court for the Eastern District of Texas said in a Tuesday opinion.

A visa application doesn’t constitute a claim for money or property, the court said.
