Taro Pharmaceuticals Beats Website-Chat Lawsuit for Second Time

Taro Pharmaceuticals USA Inc. defeated for the second time a proposed class action alleging it allowed a provider of website-surveillance software to record consumers’ chat conversations with customer support in violation of California’s wiretap law.

Plaintiff Anne Heiting failed to show that the software provider, Genesys Cloud Services Inc., recorded the website chats while they were “in transit,” a necessary element of a claim of secretly intercepting communications under the California Invasion of Privacy Act, Judge Sherilyn Peace Garnett of the US District Court for the Central District of California said Tuesday.
