An American company’s patent lawsuit against a Swiss rival over bags and backpacks with phone or laptop charging capabilities will likely avoid an early death, as a magistrate judge in Waco, Texas, swatted aside arguments to kill the case.
Wenger SA, which licenses its Swiss Gear trademark for luggage and other products, had moved in April 2022 for early dismissal of the lawsuit filed a year earlier by Swissdigital USA Co. Buffalo, N.Y.-based Swissdigital had accused Wenger of ripping off US Patent Nos. 10,574,071 and 10,931,138 through the sale of backpacks with USB charging capabilities.
