Susman Clash With Client Arigna Yields Exit From BMW Patent Case

Susman Godfrey LLP can withdraw as Arigna Technology Ltd.'s counsel in a BMW declaratory-judgment lawsuit over its client’s patent because there’s “at least a serious risk” their involvement in a related litigation-funding dispute could raise ethical concerns, a federal judge ruled.

A Delaware federal judge earlier this week paused Arigna’s separate case against Longford Capital Fund III LP, a private investment fund managed by Chicago-based Longford Capital, over the distribution of a $100 million settlement from a patent-enforcement campaign while an arbitrator determines what issues are within its jurisdiction to resolve.
