Surf Simulator Company Wins $550,000 Fee Award in Patent Suit

Pacific Surf Designs Inc. should be reimbursed roughly $550,000 of nearly $3 million in attorneys’ fees and costs that the surf simulator company incurred while successfully defending a patent lawsuit over a water ride, a Southern California judge ruled.

U.S. District Judge Roger Benitez in San Diego earlier this year found FlowRider Surf Ltd. and Surf Waves Ltd. had taken an “exceptionally weak” and “frivolous” litigation position as it related to one patent in their lawsuit, justifying a fee award.
