Supreme Court Sends Appliance Efficiency Rules to DC Circuit

Gas trade associations will be able to continue their challenge to Biden-era restrictions on certain types of consumer gas furnaces and commercial water heaters after the US Supreme Court on Monday overturned an appellate court’s decision and sent it back for further consideration.

The American Gas Association, American Public Gas Association, and National Propane Gas Association claimed the Department of Energy’s regulations blocked the sale of non-condensing furnaces and heaters in violation of the Energy Policy and Conservation Act.
