Golf apparel company Subpar LLC has reached a settlement with Golf Magazine publisher EB Golf Media LLC over use of the “Subpar” trademark, according to a filing in the Southern District of Florida.
The complaint alleges that EBG was using the mark in connection with its Subpar podcast, in social media content, and in hand-lettered headbands.
Under the agreement, EBG is enjoined from marketing, advertising, promoting, selling or distributing any goods, including clothing, accessories and golf products, that bear the designations Subpar or SBPR.
