Steven Madden Sues Rothy’s After Threats About Ballet Flats

Steven Madden Ltd. filed a pre-emptive lawsuit asking a federal court to rule that its Rosy Flat shoes don’t copy design elements of popular startup Rothy Inc.’s competing The Point ballet flat.

Steven Madden is seeking declarations that the Rosy Flat doesn’t infringe seven of Rothy’s patents or the trade dress; doesn’t dilute or misappropriate Rothy’s trade dress, which Madden also wants declared invalid; that Madden owes no damages; and that sales of its own product shouldn’t be blocked, according to complaint filed Aug. 12 in federal court in Wilmington, Delaware.
