The dismissal comes after the U.S. District Court for the Southern District of New York’s May 8 determination that Madden’s flat sandal design didn’t infringe YSL’s high-heeled sandal design patent because of “numerous visual differences.”
The court had allowed YSL’s claims that Madden infringed the trade dress of its Tribute high-heeled sandals and toe-bed to continue.
Madden’s attorney told Bloomberg Law that the parties voluntarily dismissed the case pursuant to a confidential settlement agreement.
