New Balance Athletics Inc. sued Steve Madden Ltd. Tuesday, alleging that their “Chasen” model sneaker deliberately copies New Balance’s patent-protected and trademarked 327 model sneaker.
The lawsuit, filed in Massachusetts federal court, claims that the Chasen sneaker infringes on New Balance’s design patent for the 327 sneaker’s novel sole design, in which a distinctive pattern of circular treads curls up the front and back of the shoe, and that it rips off New Balance’s protected “N” logo on the shoe’s side.
