Startup Wins Patent Row Fees After Owner’s ‘Troubling’ Conduct

Rothschild Digital Confirmation LLC must reimburse a Kansas startup for attorneys’ fees incurred after Rothschild sued over a digital image patent found to cover ineligible subject matter.

CompanyCam Inc.’s award comes several months after Judge Maryellen Noreika in the U.S. District of Delaware ruled the patent’s claims are invalid because they cover nothing more than an abstract idea.

Noreika said Rothschild had a relatively weak case but because of the uncertainties in patent eligibility law, the judge probably wouldn’t have awarded fees had it not been for a “troubling” pattern of litigation conduct from Rothschild.
