Spotify Beats Cannabis Company Mark ‘Potify’ at Trademark Board

The Trademark Trial and Appeal Board refused to register “Potify” for a software platform for marijuana dispensaries, finding that it would dilute Spotify AB’s mark.

The two marks are “strikingly similar” in appearance and sound, the TTAB wrote in a precedential opinion. The Potify mark is likely to impair the distinctiveness of Spotify’s mark because consumers would be reminded of the music streaming service even if they don’t believe the company is associated with Potify, the TTAB said.
