An overseas online retailer that allegedly sold counterfeit items bearing trademarked sports logos will ask the Seventh Circuit to hold that a federal court in Illinois lacks jurisdiction to hear claims by the NBA, MLB, NFL, NHL, and others.
The U.S. District Court for the Northern District of Illinois denied retailer HANWJH’s motion to dismiss the case, after finding the seller opened itself to suit in Illinois by shipping products to the state.
The court rejected the seller’s contention that “the entirety of its contacts with Illinois is a sham transaction by the plaintiffs.”
