Split Fourth Circuit Lifts ‘GT Racing’ Ad Block for Gaming Chair

Gaming chair company Wudi Industrial (Shanghai) Co. Ltd. convinced a divided Fourth Circuit to reverse a district court order preventing the company from purchasing Google ad-words for the trademark “GT Racing” in European countries.

A federal court in Virginia failed to adhere with the Federal Rules of Civil Procedure when it granted a preliminary injunction against Wudi in April 2022, a divided panel for the appeals court on Monday found.

Circuit Judge Allison Rushing dissented, finding that the lower court was only enforcing a settlement agreement, not issuing an injunction, so it didn’t have to adhere to those rules. ...
