Split Court Affirms Patent Infringement By Sprint Nextel’s Mobile Device Location

Sprint Nextel Corp. waived arguments a lower court’s claim constructions, and so was properly denied judgment as a matter of law after a jury found the wireless network provider liable for infringement, the U.S. Court of Appeals for the Federal Circuit held in a 2-1 decision Aug. 3, (Enovsys LLC v. Nextel Communications Inc.).

The dissent faulted the majority for applying the waiver to Sprint Nextel’s infringement arguments.
