‘Space Force’ Trademark Bid to High Court Attacks Trademark Law

An intellectual property attorney asked the US Supreme Court to nullify a legal provision blocking him from registering a “US Space Force” trademark.

Thomas D. Foster APC argued the provision barring registration of marks that “falsely suggest a connection” with institutions or national symbols is “unconstitutionally vague,” in a petition to the justices docketed Wednesday. He also said the US Court of Appeals for the Federal Circuit’s ruling improperly deferred to the US Patent and Trademark Office’s interpretation of that provision after the high court found such deference improper last year.
