Some Sysmex Patent Claims Upheld As Danaher Unit Trial Looms

A Delaware federal judge upheld some patent claims that Sysmex Corp. alleges blood-sample analyzers sold by Danaher Corp.’s Beckman Coulter Inc. infringe, adopting a magistrate judge’s recommendation that he clear those claims of Beckman’s invalidity arguments based on a third party’s sale of a similar product.

Judge Joseph F. Bataillon adopted Magistrate Judge Christopher J. Burke’s May 20 report and recommendation, granting Sysmex’s request that he uphold the validity of several asserted claims of two patents, according to an opinion issued Thursday in the US District Court for the District of Delaware.
