The U.S. District Court for the District of Delaware dismissed Uniloc’s case after determining Uniloc didn’t have standing because it gave Fortress Investment Group LLC broad rights in the patent if Uniloc defaulted on a loan. Uniloc appealed to the U.S. Court of Appeals for the Federal Circuit, arguing it owned the patent when it sued, and Fortress never exercised its right to sublicense the patent.
