Soda Company Olipop Files Trademark Suit Over Olive Snack Brand

Prebiotic soda maker Olipop Inc. sued snack company Nutruit LLC, alleging it willfully infringed Olipop’s federally registered trademarks with olive products.

Nutruit since at least March 2024 has been selling olive snack products using Olipop branding in violation of Olipop’s trademark rights, according to a complaint filed Thursday in the US District Court for the Southern District of New York.

The complaint brings claims for federal trademark infringement and unfair competition under federal and state laws, as well as trademark dilution and deceptive trade practices under New York law. Olipop seeks injunctive relief, enhanced damages for willful infringement, profits, costs, ...
