Gun maker Smith & Wesson Inc. alleged that machining company SW North America Inc. infringed its trademarks by expanding into the firearms manufacturing industry, a lawsuit filed in Nevada federal court said.
The complaint said that while SW North America traditionally makes metal-cutting machines sold for manufacturing in the automotive, agricultural, and aerospace industries, the company recently began making machines that manufacture firearm parts.
Smith & Wesson said it has used the trademark S&W since 1880 and that SW North America’s use of a similar sounding name in the same industry will cause confusion.
