Sketchers ‘Cozy Fit’ Trademark Invalid, Chinese Scrubs Seller Says

A Chinese scrubs company sued Skechers USA alleging that it doesn’t infringe the shoe maker’s “Cozy Fit” trademark and that the trademark registration should be canceled.

Wenzhou Zehui Clothing Co.'s “Cozyfit” scrubs won’t confuse consumers, who will perceive Sketchers’ use of “Cozy Fit” as merely descriptive rather than as a trademark, the Chinese company told the US District Court for the Central District of California on Tuesday. The company has sold medical scrubs and healthcare uniforms under “Cozyfit” since July 2023—before Sketchers’ claimed first use—without any known instances of confusion, the complaint said.
