Sisvel Revives Data-Transmission Patent Challenged by Honeywell

The Federal Circuit revived a parts of a Sisvel SpA data-transmission patent that it’s asserted against a handful of tech and telecommunications companies including Honeywell International Inc. and Sierra Wireless ULC.

Chief Judge Kimberly A. Moore said the Patent Trial and Appeal Board needs to take another look at Sisvel’s US Patent No. 7,869,396 because its September 2022 decision erroneously misread a figure in an earlier-filed international patent application. The board’s interpretation of that application “is not supported by substantial evidence,” Moore said in a precedential opinion issued Monday by the US Court of Appeals for the Federal Circuit. ...
