Sirius XM Patent-License Suit Revived at the Federal Circuit

A German patent owner’s Delaware infringement suit against Sirius XM Radio Inc. is back on after the Federal Circuit revived it for a second time Monday.

The three-judge appellate panel ruled a lower court’s grant of a pre-trial win to the satellite radio company was improper. Sirius had “not established through undisputed evidence that it relied on Fraunhofer’s misleading conduct,” Judge Alan D. Lourie wrote in a precedential opinion for the US Court of Appeals for the Federal Circuit.

Fraunhofer-Gesellschaft, a Munich-based research organization, sued Sirius in 2017, accusing the radio company of copying four patents that have since expired. ...
