Sirius Beats SoundExchange’s $150 Million Music Royalty Suit (1)

Sirius XM Radio Inc. defeated SoundExchange Inc.'s $150 million lawsuit accusing the satellite radio provider of failing to pay music royalties.

SoundExchange, the recording industry’s congressionally designated collective rights organization, isn’t authorized to bring the royalty lawsuit under federal copyright law, according to an order issued Thursday in the US District Court for the Southern District of New York.

The text of the Copyright Act “offers compelling evidence that Congress deliberately considered the scope of SoundExchange’s enforcement power and intentionally opted not to include litigation authority as an arrow in its quiver,” Judge Naomi Reice Buchwald wrote.
