Short Febreze Jingle Didn’t Infringe Song Copyright, Court Says

Proctor & Gamble Corp. escaped a copyright lawsuit because the writer of a 1980s song failed to plead that a five-note Febreze jingle duplicated enough of the composition to warrant a copyright claim.

Songwriter Cameron Cates failed to show the notes and overlapping “la-la-la-la-la” allegedly stolen from his 1982 song “She Loves Her Job (And I Love Her Too)” warranted copyright protection, the US Court of Appeals for the Northern District of New York said Friday. Proctor & Gamble didn’t dispute the notes were the same, but the court said that would constitute “at most, de minimis copying.”
