Shopify Wins Non-Infringement Order After $40M Patent Suit Loss

Shopify Inc. convinced a federal judge that its website building tools didn’t infringe Express Mobile Inc. patents at the center of a $40 million jury verdict against the e-commerce company.

Express Mobile failed to show that Shopify’s add-to-cart and YouTube functionalities both receive input and display output as detailed in the three patents asserted in the case, Judge Richard G. Andrews said in an opinion filed May 17 in the US District Court for the District of Delaware. Andrews found Shopify didn’t infringe the patents because all of the asserted claims require that component.
