Shibumi Shade Inc. won an order that will temporarily block the sale of a rival’s beach shades, after convincing a North Carolina federal judge it has a strong case for patent infringement.
Shibumi likely can prove that Beach Shade LLC infringes two of its patents, Judge Louise Flanagan in the U.S. District Court for the Eastern District of North Carolina said Tuesday.
Granting Shibumi’s request for a preliminary injunction, Flanagan also found Shibumi would likely be irreparably harmed without an injunction. The judge took note of the company’s “seasonal business model.”
