Shein trimmed down a lawsuit brought by ultra-fast fashion rival Temu but still must face copyright and trademark infringement claims after a federal judge partly denied its motion to dismiss.
Whaleco Inc., which operates as Temu, sufficiently alleged Shein launched a “bad-faith campaign” to take down Temu posts with sham copyright complaints, defrauded the US Copyright Office, and infringed trademarks covering the design of Temu’s website and mobile app, according to an opinion published Tuesday in the US District Court for the District of Columbia.
