Sferra Fine Linens LLC won a second chance to block registration of another brand’s ‘Sfera’ trademark as the Federal Circuit vacated a tribunal’s ruling and sent the decade-old case back for more proceedings.
The Trademark Trial and Appeal Board didn’t sufficiently weigh the marks’ similarity and failed to address evidence they covered at least somewhat related goods, the US Court of Appeals for the Federal Circuit said in an nonprecedential opinion filed Monday. The board had found that while the marks were highly similar, the goods were sufficiently different that the marks wouldn’t likely cause confusion.
