Serial Patent Challengers Target of Agency’s Updated Guidance

Patent challengers now must explain in writing why they’re making multiple attacks against the same patent, under new revisions to the Patent and Trademark Office’s trial practice guide.

The updated guide, announced July 15, comes less than a year after the agency refined its trial procedures. In addition to the new rules for challenges before the Patent Trial and Appeal Board, the guide also advises what parties must do after the U.S. Court of Appeals for the Federal Circuit asks the patent board to reconsider a dispute.
