Idaho can enforce a law that prevents independent schools from distributing books the state deems “harmful to minors,” after a federal judge denied their bid to preliminarily block the statute.
The plaintiffs, which include the Northwest Association of Independent Schools, failed to show that they will succeed on the merits of their claims that the law violates the First Amendment because it precludes a “staggering amount” of protected speech, and that it’s unconstitutionally vague under the 14th Amendment, Judge Amanda K. Brailsford said Tuesday for the US District Court for the District of Idaho.
