Adult film producer Strike 3 Holdings LLC convinced the federal D.C. Circuit Tuesday that a judge gave too much weight to the “aberrantly salacious nature” of its films when he denied a motion to identify the subscriber to an IP address linked to alleged piracy.
The U.S. Court of Appeals for the District of Columbia’s ruling may bolster a litigation strategy that the lower court judge described as “smacking of extortion.” But the appeals court said Strike 3’s strategy didn’t justify dismissing its suit.
