Rubicon Beats Metacel Appeal on Muscle-Relaxant Storage Patent

A New Jersey federal judge was right to rule that Rubicon Research Private Ltd. didn’t infringe a Metacel Pharmaceuticals LLC patent on storing its muscle relaxant medication, the Federal Circuit said.

The case centers on whether Rubicon’s generic version of Metacel’s Ozobax, whose label includes storage instructions that permit refrigeration, infringes Metacel’s US Patent No. 10,610,502. The patent, which Bloomberg Law estimates will expire in August 2039, covers a method for treating muscle spasms using a liquid form of baclofen, the drug’s active ingredient.
