Rothy’s Settles Patent, Trade Dress Dispute Over Ballet Flats (1)

Rothy’s Inc. has settled a patent and trade dress infringement lawsuit alleging its competitor’s ballet flats are too similar to its shoes.

The U.S. District Court for the Western District of Virginia granted Rothy’s and OESH’s motion to dismiss, Rothy’s said in a Sept. 19 statement. The shoemakers told the court Sept.18 that they had reached a confidential settlement agreement.

The settlement is a win for Rothy’s, known for its comfortable flats made with recyclable materials. The company previously said it would generate more than $140 million in 2018 revenue.
