Rolex Watch U.S.A. Inc., convinced a Texas federal court to block a refurbished watch seller from infringing on the Rolex trademark but failed to force the seller to disgorge profits from using the Rolex name.
BeckerTimes sells “refurbished” luxury watches, including Rolex watches, which it repairs using both Rolex and non-Rolex parts. BeckerTime identifies the watches it sells as “genuine Rolex,” and has called itself a “Rolex Certified Master Watchmaker,” Rolex told the U.S. District Court for the Northern District of Texas.
