Rockwell, Radwell Settle Long-Running Trademark Dispute in N.J.

Rockwell Automation Inc. and Radwell International Inc. resolved their five-year-long dispute over Radwell’s resale of Rockwell industrial equipment on the gray market, according to a filing in New Jersey federal court.

The U.S. District Court for the District of New Jersey ruled in November that Radwell infringed Rockwell’s trademarks by reselling Rockwell-branded products without permission and in a “materially different” form because they lacked Rockwell’s warranty, quality control, or customer support guarantee. Rockwell also won on false advertising, tortious interference, and other claims.
