“Road House” screenwriter David Lee Henry appealed the denial of his bid to strike Metro-Goldwyn Mayer Studios Inc.'s breach of contract counterclaims from a copyright lawsuit on free speech grounds to the Ninth Circuit.
Henry, who’s legal name is R. Lance Hill, had argued unsuccessfully in California federal court that the state’s anti-Strategic Lawsuit Against Public Participation law barred MGM’s breech of contract claim. A federal judge found MGM’s counterclaim centered on alleged misrepresentations in a 1986 contract that didn’t constitute activity protected under the anti-SLAPP statute, rather than on Henry’s 2021 termination notice.
