Revance Loses Review Bid Against Medytox Wrinkle Treatment Patent

Revance Therapeutics Inc. lost its bid for administrative review of a Medytox Inc. wrinkle treatment patent, as a patent office tribunal said it wasn’t convinced Revance could show the patent is invalid.

Revance argued the patented invention would’ve been obvious to a scientist who read a Botox label in combination with earlier patent applications. The Patent Trial and Appeal Board denied inter partes review in a pair of decisions Wednesday.

“Petitioner has not met its burden to show a reasonable likelihood that it would prevail in this challenge,” the board wrote.
