Rémy Martin’s Cognac Bottle Infringement Lawsuit Can Proceed

E. Rémy Martin & Co.'s design patent infringement suit against a cognac maker and an Italian bottle manufacturer will go forward, as it plausibly alleges ordinary people would be confused by the bottles, a federal court in New York said.

Rémy Martin’s complaint identified the patent and its ownership, showed the patented bottle design, described the accused bottle, and alleged the accused bottle is so “substantially similar” to the patented design that an ordinary observer would be deceived by it, the U.S. District Court for the Southern District of New York said.
