Regeneron Escapes Viatris Counterclaims Ahead of Patent Trial

Regeneron Pharmaceuticals Inc. won a judgment clearing it of Viatris Inc.’s inequitable-conduct counterclaims regarding two of three patents that Regeneron alleges a proposed biosimilar of Eylea infringes ahead of next week’s bench trial over the retinal-disease treatment.

Judge Thomas S. Kleeh granted Regeneron’s motion for judgment as to Mylan’s the defenses and counterclaims regarding US Patent Nos. 10,888,601 and 11,253,572, both of which cover dosing. Mylan failed to allege facts sufficient to state defenses or counterclaims based on inequitable conduct, he wrote in an order issued Tuesday in the US District Court for the Northern District of West Virginia. ...
