Raytheon’s Patriot Contract Data Protection Claim Advances

Raytheon Co. may ask the U.S. Court of Federal Claims to declare that the U.S. Army violated data protection requirements when it forced the contractor to affix government data rights markings on vendor lists used under Patriot missile contracts, the court said.

It may review “nonmonetary disputes on which a decision of the contracting officer has been issued” under the Contract Disputes Act, Judge Elaine D. Kaplan said, rejecting the government’s motion to dismiss one of five counts in Raytheon’s complaint.
