A whistleblower can move forward with his claim that Arizona-based Radiology Ltd. violated the False Claims Act by using Dell computer monitors that didn’t satisfy Medicare standards for radiology services, a federal district court said.
Eric Stenson, an information technology executive, adequately alleged that Radiology “was aware of a substantial and unjustifiable risk” that the monitors issued diagnostic readings that fell below minimum standards, but still submitted claims for those readings, Chief Judge Jennifer G. Zipps of the US District Court for the District of Arizona said in a Tuesday order denying the defendant’s motion to dismiss.
