Puma, Brooks Settle Track Shoe Patent, ‘Nitro’ Trademark Suits

Puma SE and Brooks Sports Inc. settled a pair of shoe lawsuits involving a track shoe utility patent and a “Nitro” trademark along with various design patents.

The agreement ends Puma’s trademark and design patent suit against Brooks filed in 2022 and its utility and design patent suit filed last June, both of which ended up in the US District Court in the Western District of Washington. A judge advanced the trademark case in May, finding Puma’s complaint adequately alleged Brooks unlawfully used Puma’s “Nitro” trademark and infringed US Patent No. D897,075 covering running shoes with a “bulbous” sole.
